The Omsk regional court satisfied the private complaint of the AO Omsky kauchuk (part of the Titan Group) and supported the request to postpone the development of the project of maximum permissible emissions (MPE) until September of this year.
As a reminder, in August 2020, the Sovetsky District Court ruled on a lawsuit filed by the Siberian Interregional Department of Rosprirodnadzor. The plant was obliged to bring the inventory of emission sources and draft standards of maximum permissible emissions (in terms of accounting of fugitive emissions from stationary sources) into compliance with the requirements of current legislation within 6 months from the effective date of the court decision.
The AO Omsky kauchuk immediately signed a contract with a design organization to make changes to the draft MPE. However, due to gaps in legislation, it turned out to be impossible to execute the court's decision within the stated period of time. It is about the cancellation of existing methodologies for calculating harmful emissions and the lack of new ones. As a result, the developed draft MPE was not approved.
After that, a new contract was signed with a leading design organization to develop a draft MPE project, which set the minimum deadline for developing the project at September 2022. Therefore, the plant appealed to the Sovetsky District Court with a request to postpone the deadline, but was denied. The company, insisting on its position, submitted a private complaint to the Omsk Regional Court.
It is established that the above circumstances indicate the impossibility of executing the court decision of October 23, 2020 within the time frame set by the court. It does not mean that the AO Omsky kauchuk failed to act until July 22, 2021 (within 6 months from the date of entry into force of the court decision). On the contrary, the enterprise undertook and is undertaking all measures for execution of the judicial act as soon as possible. Thus, the Omsk Regional Court supported the position of the Omsky kauchuk.
